An investigation into the events arising from a motor vehicle accident involving Mr Jeffrey Shaw QC on 13 October 2004, at Louisa Road Birchgrove. On 2 November 2004 NSW Police made a public announcement that it had commenced an internal investigation because a vial of the blood taken from Mr Shaw at the hospital, which should have been delivered to the police Blood Sampling Unit (the Police Sample), could not be accounted for. Following a meeting on 3 November 2004 with senior members of NSW Police, the NSW Ombudsman and the Independent Commission Against Corruption, the Commission took over the investigation into the missing vial of blood. The hearing was held over three days, 15, 16 and 17 November 2004. Following the hearing written submissions were made to the Commission by Counsel Assisting the Commission and the legal representatives for the witnesses. The preparation of this Report was delayed as a result of proceedings commenced in the Supreme Court of New South Wales in December 2004. Those proceedings, brought on behalf of Mr Shaw, sought to limit the matters in respect of which the Commission could report to Parliament. The proceedings were resolved in the New South Wales Court of Appeal in July 2006.
